Here
are the rules regarding the new Homebuyer Tax Credit:
10% of the purchase price up to $8000
New or existing homes purchased between January 1, 2009 and November 30, 2009
No repayment is necessary as long as it is maintained as a principal residence for at least 3 years. Anything less than 3 years will be subject to recapture
Borrowers have already purchased in 2009 under the old guidelines (with repayment) can file an amended return for the higher amount with no repayment.
Borrowers who buy in 2009 can claim this on their 2008 return by filing an amendment. What this means is it would be possible to get a check for the credit to be used for down payment and/or closing costs.
